 Competition Commission reacts to ports policy
Parr said three forms of competition should be present; competition between SA ports (inter-port competition), within each port for providing certain port services (intra-port competition) and competition relative to South African ports international counterparts.
The Commission advocated that within each port, and in respect of certain services, the way to introduce vigorous competition might be to have competition in advance (ex ante) for the market, rather than competition in the market.

 Competition Commission renews debate over LSE takeover
The Competition Commission has chosen to reawaken the debate on the feasibility of the proposed takeover bids by saying that both the bids would seriously affect fair competition.
The Commission's objection stems from the fear that both the clearing services would close the door on other clearers who could offer their services to LSE's customers at competitive prices.
Analysts were of the opinion that had the commission wanted to pull up both bidders, it would have objected to the ownership of Clearstream.

The Government may consider the option of amending the existing Competition Commission legislation in view of the Supreme Court's concern over the decision to appoint a bureaucrat rather than a retired chief justice as the head of this new regulatory agency.

Johannesburg - The large-scale amendment of the legislation regulating competition between companies in the country has now made it possible for the authorities to approve the planned takeover of BoE by Nedcor without the Competition Commission having to consider the matter.
In evidence delivered before Parliament, chairperson of the Competition Commission Advocate Menzi Simelane said the South African Reserve Bank is planning to submit a request to Finance Minister Trevor Manuel asking that the Competition Commission should not have jurisdiction over the planned takeover.
The legislative amendments stipulate that the Competition Commission has jurisdiction over all economic activities in the country except where a collective agreement in terms of the provisions of the Labour Relations Act applies.

 IOL: Competition Commission's finding a 'surprise'
The Competition Commission's statement that it had found evidence of anti-competitive practices by motor manufacturers, dealers, importers and distributors came as a surprise, Volkswagen South Africa said on Tuesday.
Naamsa had been cited by the commission as one of the respondents in their investigations but on Tuesday the commission said no evidence suggesting anti-competitive practices contravening the Competition Act was found against it, nor was there evidence it had been used as a forum for price-setting collusion.
The commission announced in Pretoria on Tuesday that a collusion and price resale maintenance case would be referred to the Competition Tribunal where the implicated parties would be prosecuted.

A Competition Commission inquiry into the distribution of veterinary medicines has been ordered by the director-general of fair trading, Sir John Vickers.
The £200m-a-year market has been referred to the Competition Commission after the OFT found evidence that prices in the United Kingdom are substantially higher than in other European countries.
The commission has 15 months to report to the Secretary of State for Trade and Industry on whether a complex monopoly exists in the sector and, if so, whether the situation is being exploited, and whether the monopoly operates, or may be expected to operate, against the public interest.

The Competition Commision has concluded that Britain's shoppers are, by and large, getting a fair deal from their supermarkets, but has identified a few issues that should be resolved by the Office of Fair Trading.
The Commission conducted a very thorough inquiry, and found that some of the larger supermarkets had sufficient buyer power that 30 of their practices adversely affected the competitiveness of some of their suppliers and distorted competition in the supply market.

 Safeway: four from five referred to Competition Commission
The OFT concluded that at a local level, the loss of competition between Safeway and any of the four largest existing grocery retailers in certain areas appeared to be substantial.
The company said in a statement that it would co-operate fully with the Competition Commission's investigation and that it remained “fully committed to achieving an outcome which is in the best interests of shareholders, the business and our employees”.
