CompTel's theory, by contrast, would mean that once the Commission found a single purpose as to which an "element" met the impairment standard, no matter how limited, it would be forced to man- date provision of the element for all, no matter how little potential impairment was involved in the remainder of the telecommunications field.
CompTel and intervenors argue that it is much more cost effective to use the same transport facility for both local and long distance than to have two separate facilities, each carrying a smaller amount of traffic.
In their opening briefs both CompTel and intervenors argued that the restriction on commingling was oppressive, and they stated in a cursory manner (CompTel devoting all of one page to the issue) that it was not needed to carry out the FCC's goal of preventing special access bypass.

 CGRO COMPTEL
In some ways, COMPTEL is similar to an optical camera: the upper detector, analogous to a camera's lens, directs the light onto the second detector, comparable to the film, in which the scattered photon is absorbed.
In this mode an incident cosmic gamma ray is electronically identified by a delayed coincidence satisfying time-of-flight criteria between the upper and the lower detectors, combined with the absence of a signal from all charged particle shields and from the calibration detectors.
COMPTEL can then automatically be commanded to enter an alternate event selection mode to measure solar neutrons for a period of 90 minutes (or approximately one orbit of the spacecraft).

CompTel does not appear to deny either that the Commission can justify a policy by reference to the purposes of avoiding disruption pending a broader reform, or that the EEL restriction would disrupt implicit subsidies contained in access charges.
CompTel's second target, the Commission's anti-commingling rule, essentially "does not allow loop-transport combinations [taken as UNEs] to be connected to the incum1ent LEC's tariffed services." Clarification, 15 FCC Rcd 9587 at p 22.

CompTel also opposes a separate charge for call setup on the ground that no state regulatory body has established such a charge and there are no grounds on which to establish the rate level.
CompTel agrees that it is critical to adopt a TSLRIC standard in order to foster competition and to promote efficiency in network design and service development, and strongly supports the use of TSLRIC as the appropriate standard for setting prescribed rates for access services.
CompTel recognizes, however, that the magnitude of non-cost amounts embedded in existing switched access revenues is enormous, and that a "flash cut" of access rates to TSLRIC may be considered infeasible.

COMPTEL ACCUSES VERIZON OF PLAYING HIDE AND SEEK
This worries the Competitive Telecommunications Association (CompTel), which alleges Verizon Communications — the first incumbent to win 271 approval, two years ago in New York — is hiding information from the public in an audit conducted by PricewaterhouseCoopers and submitted to the FCC last June.
In a recent letter to FCC Chairman Michael Powell, CompTel alleged the version of the report available for public scrutiny and comment is so heavily redacted that neither the association nor its members can tell whether Verizon complies with Section 272.
CompTel is concerned that redaction will become a favorite tool of Bell companies wanting to hide critical information in future 272 audits if the FCC permits it this time.

AT&T and CompTel contend further that the FCC's determination, that the IXC investment in the SS7 system constitutes a "general network upgrade" with costs that must be recouped in general charges to be paid by all users and not in rates targeted to recipients, is contrary to prior FCC decisions.
AT&T and CompTel point to a decade of FCC decisions recognizing that telecommunications services may be priced to exceed their marginal or incremental costs -- and must in aggregate recover the fully distributed or average costs.
AT&T and CompTel base their argument that the FCC impermissibly engaged in ratemaking on a series of cases that hold that "the actual impact of agency action and not its form is decisive." E.g., AT&T v.
