  TPWD: Concessions
Concessions are a significant element in the Texas State Park System.
A concession may be as simple as vending machines or as complex as a resort development at Ray Roberts Lake or a golf course at Bastrop State Park.
The purpose of offering a concession program is to seek public/private partnerships and assistance, where appropriate, and to provide quality services, programs, and facilities that enhance the enjoyment and provide convenience and recreational experiences for state park visitors.

 Questions and Answers about Concessions
Concessions are private businesses operating under contract in state parks to provide products and services designed to enhance the park visitor’s experience but are not normally provided by State employees.
Concessions can be proposed by: 1) a park’s general plan process; 2) a district superintendent who sees a need for a concession; 3) a member of the public; 4) an entrepreneur or a corporation; 5) a legislative mandate; or 6) a local agency under an operating agreement with the Department.
Concession opportunities also are advertised in State and regional newspapers, in the State’s contracts registry, in minority and trade newspapers, and on the Department’s website (www.parks.ca.gov).

Tenders Direct: Concessions under community law
Indeed, insofar as these concessions result from acts of State, the purpose of which is to provide economic activities or the supply of goods, they are subject to the relevant provisions of the Treaty and to the principles which derive from Court case law.
In conclusion, the risks arising from the operation of the concession are transferred to the concessionaire with the right of exploitation; specific risks are divided between the grantor and the concessionaire on a case by case basis, according to their respective ability to manage the risk in question.
As already stated, even though concessions are not directly addressed by the public contracts directives, they are nonetheless subject to the rules and principles of the Treaty, insofar as they are granted via acts that are attributable to the State and their object is the provision of economic activities.
