Another major problem with concurrency is that key public bodies - including the state legislature - do not want to raise taxes; therefore, they may refuse to fund the road construction that has been planned to offset new developments.

Concurrency means that transportation facilities must be available to carry the traffic of a proposed development at County level of service standards, or else the proposed development cannot be approved.
Concurrency is determined by adding the traffic from the proposed development to the traffic already on the roads and then calculating the projected level of service.
Concurrency cannot be transferred to other parcels (because they may be in different concurrency zones or different land uses).

The law basically states that a local government (municipality or county) cannot approve a new development unless it finds that there will be adequate transportation facilities to serve the traffic from that new development, at the time of occupancy.
Concurrency may be satisfied if improvements to the overcapacity roadway are provided for in an enforceable development agreement, and will be available prior to certificates of occupancy.

The Growth Management Act directed counties and cities to ensure road improvements or other transportation fixes necessary to serve new homes, supermarkets and offices were made "concurrent" with, or at the same time as, the development.
The promise that roads would keep pace with growth largely was the reason why the Growth Management Act passed, said Richard Aramburu, a Seattle attorney who has practiced land-use and environmental law since 1970.
While the 1990 growth law directed counties and cities to make sure roads and infrastructure are built in conjunction with developments, it let local governments interpret the meaning of concurrency.

A concurrency certificate—the first step in getting a housing project approved—is the county's determination that the project will not overly strain the surrounding road system; under the state's Growth Management Act, cities and counties are only supposed to approve as much development as their transportation infrastructure can handle.

Impact fees are only used to fund facilities, such as roads, schools, and parks, that are directly associated with the new development.
GMA impact fees are only authorized for public streets and roads; publicly owned parks, open space, and recreation facilities; school facilities; and fire protection facilities in jurisdictions that are not part of a fire district.
