The Borough of Warrington was formed by the amalgamation of the former County Borough of Warrington, part of the Golborne Urban District, the Lymm Urban District, part of the Runcorn Rural District, the Warrington Rural District and part of the Whiston Rural District.

In these proceedings Mr Tomlinson sues the Congleton Borough Council and the Cheshire County Council, claiming that as occupiers of the Park they were in breach of their duties under the Occupiers' Liability Acts 1957 and 1984.
The Borough Council bought the land in 1980 and most of the work of landscaping and planting was finished by 1983.

Congleton Borough Council has been found not liable for the injuries suffered by John Tomlinson when he ignored notices prohibiting swimming in a lake, and executed a dive that broke his neck and left him unable to walk.
Cheshire County Council managed the park on behalf of the Borough Council and from the outset swimming was treated as a prohibited activity.
He claimed that Congleton Borough Council and/or Cheshire Borough Council as occupiers of the park were in breach of their statutory duties under the Occupiers’ Liability Acts 1957 and 1984.
