Connex SE submitted that it was "an abuse of process" for MJ to start adjudication proceedings so long after it purported on 29 November 2002 to accept a repudiation of the contract by Connex SE.
Connex SE submitted that Parliament was content for adjudication to take place after the cessation of work because this was seen in the context of a procedure which was (a) quick, (b) cheap and (c) a temporary decision.
Connex SE argued that if, as a result of the passage time, it was no longer possible to have a quick, cheap and temporary adjudication, then it was an abuse of process to permit an adjudication to take place.

The public accounts committee's report on the franchise found that Connex and the SRA did not communicate enough and that the SRA was slow to realise the difficulties Connex was in.
Connex was granted the 15-year south-eastern franchise in 1996 but it was terminated in 2003 after the SRA decided it was not doing enough to improve poor performance.
The committee did praise the transfer of the franchise to South Eastern Trains but said that there were lessons to be learnt for the future, adding that allowing "hope to triumph over experience" in franchise bids should never happen again.

In December, when Connex finally has gone, the SRA will then bring forward the competition for a new Integrated Kent Franchise, incorporating existing South Eastern services and the planned high-speed domestic services on the Channel Tunnel Rail Link, with the winning private-sector company taking over within 12 to 18 months.

 Train firm offers cash for drivers not to be ill
Connex South Eastern, which runs London-Kent trains, is introducing a yearly reward of £1,100 for its 816 drivers if they do not take days off for illness.
A similar scheme was considered a success by the firm's sister company, Connex South Central, whose 636 drivers have benefited from it for more than a year.
A similar scheme has been applied to Connex conductors, but they have cash deducted from their weekly wages if they take any sick leave.
