The Constitution has five sections: the preamble, general principles, the fundamental rights and duties of citizens, the structure of the state, and the national flag and emblems of state.
Accordingly, Article 1 of the State Constitution describes China as a "people's democratic dictatorship," meaning that the system is based on an alliance of the working classes--in communist terminology, the workers and peasants--and is led by the Communist Party, the vanguard of the working class.
Whereas the 1978 constitution stressed "self-reliance" in modernization efforts, the 1982 document provides the constitutional basis for the considerable body of laws passed by the NPC in subsequent years permitting and encouraging extensive foreign participation in all aspects of the economy.

The future "one China," like the EU or a loose confederation, will have to be for members of similar governmental systems, not incompatible ones.

 CHINA: Constitution change to promote private property
The March 5-14 annual session of China's rubber-stamp parliament, the National People's Congress (NPC), will be asked by the country's rulers to approve 14 changes to the country's constitution, the most important of which is to “encourage, support and guide the development of the non-public economic sectors”.
Since the current constitution was adopted in 1982, it has undergone three series of amendments that bear witness to and increasingly boost the country's pro-capitalist course.
Further possible changes to the constitution to strengthen the position of private employers in the country's economic and political life have been expected and hotly debated within China since 2001.
