Constitution of Canada - Wikipedia, the free encyclopedia
The composition of the Constitution of Canada is defined in section 52(2) of the Constitution Act, 1982 as consisting of the Canada Act (including the Constitution Act, 1982), all acts and orders referred to in the schedule (including the Constitution Act, 1867), and any amendments to these documents.
The colony of Canada received its first full constitution in the Constitutional Act of 1791 which established much of the composition of the government.
With the Constitution Act, 1982, amendments to the constitution must be done in accordance with Part V of the Constitution Act, 1982 which provides for five different amending formulas.

"The Canadian Constitution, A History Lesson."
We, in Canada, are blessed with a constitution which is fully traceable to the constitution of England, rooted deep, as it is, in English common law, a subject with which I deal elsewhere.
The English constitution was formed by the common law and it continues to move with it; and, the common law was allowed to grow and flourish, because of the English constitution.
The English constitution is without a measurable depth and breadth; it is, by its nature, undefinable; it is has never been written down in one spot, nor could it be.

When most people refer to the Constitution, they may be thinking of a subset of the rules that makes up the formal "Constitution of Canada." Section 52(2) of the Constitution Act, 1982 outlines what documents are part of the formal Constitution.

 Embassy Washington
The Constitution was patriated on April 17, 1982, without the consent of the Quebec legislature, but the Supreme Court of Canada subsequently ruled that the patriation process had respected Canada's laws and conventions, and that the Constitution, including the Constitution Act, 1982, was in force throughout Canada.
Canada's Constitution Act, 1867 did not include a bill of rights because it was assumed that the unwritten conventions inherited from Britain provided effective protection for civil liberties.
Consequently, when Canada officially ceased to be a British colony with passage of the Statute of Westminster in 1931, authority to amend the Constitution remained with the British Parliament.

 - Research Note - Canada's Constitution prior to 1982
The express provisions of the Constitution are not, as the Chief Justice contends, 'elaborations of the underlying, unwritten, and organizing principles found in the preamble to the Constitution Act, 1867 (para 107).
Whereas, in constitutional law, conflicts between the Constitution and an ordinary statute render the ordinary statute void to the extent of the inconsistency, such is not the case where two ordinary statutes conflict with each other.
Since the Canadian Bill of Rights is not a constitutional statute in the sense that it renders the conflicting statute void and of no effect, the significance of the statement that the court shall not apply the conflicting statute affects the doctrine of implied repeal.

Canada in the Making - Constitutional History
The vote was in favour of a change in the constitution, and in 1997 the government of Newfoundland gained authority over all schools in the province.
The passing of the Constitution Act, 1982, did not mean an end to the constitutional evolution of Canada.
After scandals involving denominational schools in Newfoundland, public opinion in that province began to turn toward changing the Constitution, allowing the provincial government to take control of education.

 Inroads: Canada's secret constitution
This has proven the most controversial of the external constitution's provisions, because it allows firms to overturn the outcomes of domestic political deliberations on the desirable regulatory regime for securing the health and safety of the citizenry of a city, a province or the federation.
Constitutions also express the balance of power between the winners and losers involved in their drafting.
The conception of an entity created by the United States and Canada, and possibly Mexico, to transform intergovernmental relations on the continent without having law-making, law-applying, law-enforcing or law-adjudicating mechanisms was both bold and controversial.

British North America Acts - Wikipedia, the free encyclopedia
By the Canada Act 1982, the British Parliament, acting at the request and with the consent of Canada, enacted the Constitution Act 1982, which established a procedure for the amendment of the Canadian constitution by the Canadian Parliament.
Canada and the other British dominions achieved full legislative sovereignty with the passage of the Statute of Westminster 1931, but prior to the Canada Act 1982 the British North America Acts were excluded from the operation of the Statute of Westminster and could only be amended by the British Parliament.
The British North America Acts 1867–1975 are generally named Constitution Acts in Canada, and together with the Constitution Act 1982 are now collectively known as the Constitution Acts 1867–1982, though they remain named as they originally were in the United Kingdom.

A constitutional monarchy is one in which the sovereign is restricted in his powers by the nation's representatives; the granting of a constitution accordingly means the transforming of a monarchy more or less absolute into a constitutional state.
