The Constitutional Democratic Party was formed in Moscow on October 12-18, 1905 at the height of the Russian Revolution of 1905 when Tsar Nicholas II was forced to sign the October Manifesto granting basic civil liberties.
Unlike the Octobrists, who were committed to constitutional monarchy from the start, the Kadets were at first ambiguous on the subject, demanding universal suffrage (even women's suffrage) and a Constituent Assembly that would determine the country's form of government.
In response, 120 Kadet and 80 Trudovik and Social Democrat deputies went to Vyborg (then a part of the autonomous Grand Duchy of Finland and thus beyond the reach of Russian police) and responded with the Vyborg Manifesto (or the "Vyborg Appeal"), written by Miliukov.

My feeling is that the Democrats do not currently have a consistent vision for interpretation of constitutional power and structure, and that Tushnet is correct in supposing that the party has been "opportunistic" about pursuing its agenda.
Constitutional "politics" has often been a matter for popular debate, and to the extent that Democrats can revive such discussion instead of always focusing on candidates and single issues, our movement to revitalize and restore social justice within the market economy could be strengthened.
The "narrowing" of constitutional politics to an internal dialogue within the Supreme Court is a lamentable phenomenon, since the Court really does have limited ability to drive a constitutional vision (despite the public diatribes against "activist" judges by social conservatives).

In his original post on Balkinization, Mark Tushnet stated -- without much elaboration -- that the Democratic constitutional vision was "something like equal dignity and respect." There's a sense in which this is correct.
Far more interesting, I believe, is the opposing constitutional vision (or visions) which find so much support among conservatives: limited or "small government" as the "original" and desired state of government.
If Democrats want to understand how to stop defending, and start building again, the weaknesses in the conservative constitutional argument are the place to start.
