The Consumer Product Safety Commission (CPSC) is an independent agency of the U.S. federal government created in 1972 through the Consumer Safety Act to protect “against unreasonable risks of injuries associated with consumer products”.
The CPSC has the authority to regulate the sale and manufacture of more than 15,000 different consumer products, from cribs to all-terrain vehicles, and from barbecue grills to swimming pools.
CPSC fulfills its mission to protect consumers against unreasonable risk of injury by developing voluntary and mandatory standards, banning dangerous consumer products, issuing recalls of products already on the market, and researching potential hazards associated with consumer products.

CPSC staff conducted wiping and/or extraction studies for lead or cadmium depending on the staff's assessment on the age of the child that would be expected to play with the product and the type of behavior expected (hand-to-mouth, direct mouthing, or chewing).
CPSC staff then evaluated the four products with detectable amounts of lead or cadmium, as determined from the wiping or extraction studies, for their potential to present a lead or cadmium health hazard.
CPSC staff considers the reasonably foreseeable use of a product by determining the age of the child using the product, the type of exposure (hand-to-mouth, chewing, mouthing), the frequency and period of exposure, accessibility, extent of exposure (area handled, mouthed, or chewed), and use environment (any exposure to heat and sunlight).

CPSC alleged that from June 2002 through September 2004, Acuity learned of 15 sites at which 510 lights were reported as failing, more than 286 cracking reflectors, 19 falling reflectors, and at least 202 cords that dripped fluid but had not yet caused reflectors to crack.

The Consumer Product Safety Commission says that there have been 48 reports of small parts separating from the toys, including two reports of children gagging on pieces, one report of a child who started choking on a piece and one report of a child who choked on a piece.
Because the use/freeze-by dates for the recalled products have expired, consumers are urged to look in their freezers for these products and, if found, discard them or return them to the place of purchase.
With all the concern about product safety today we hope the CPSC gains the resources and authority it needs to keep unsafe products off the market in the first place rather than relying on an ineffective recall process once they are already there.
