The earliest of these was recognised by the First Dáil as the legitimate army of the Irish Republic, as proclaimed in the Easter Rising in 1916 and reaffirmed by the Dáil in January 1919.
While the anti-Treaty IRA continued to exist after its defeat in the Irish Civil War, by the late 1930s it had lost most of the legitimacy with which most supporters of the Republican side initially regarded it.
They argued that the IRA's allegiance was to the Dáil of the Irish Republic and the decision of the Dáil to accept the Treaty meant that the IRA no longer owed that body its allegiance.

Irish Republican Army - Wikipedia, the free encyclopedia
In theory, the IRA was responsible to the Dáil and was the army of the Irish Republic.
The IRA was to retain its arms and the British Army was to remain in barracks for the duration of peace negotiations.
The most contentious areas of the Treaty for the IRA were abolition of the Irish Republic declared in 1919, the status of the Irish Free State as a dominion on the British Commonwealth and the British retention of the so called Treaty Ports on Ireland' south coast.

 The Continuity IRA
Despite the unionist theory, there is quite a lot of evidence that the `continuity' splinter group does exist and that it has a different agenda to that of the Provisionals.
This makes the `Continuity' IRA the military wing of an alternative state whereas the Provisional IRA is now merely the cutting edge of a political party.
A unionist theory that the Provisional IRA have given the splinter group a licence to carry out `deniable operations', for example sectarian attacks which would sully their carefully cultivated image of reasonableness.

IRA Splinter Groups (U.K., separatists) - Council on Foreign Relations
There are three IRA splinter groups: the Real IRA, the Continuity IRA, and the Irish National Liberation Army.
The Real IRA was formed in 1997 by hard-liners who opposed the negotiations being pursued by the IRA and its political wing, Sinn Fein, which culminated in the April 1998 Good Friday accord, a peace pact that renounced violence.
The group that was later established as the Continuity IRA is thought to have carried out a notorious 1987 bombing in the Northern Ireland town ofEnniskillen that killed eleven Protestants; experts say the IRA leadership saw the attack as a tactical mistake.

In terms of what has occurred over the previous thirty years, he alleges that there was a “battle for control between SIS and MI5” for Ulster and, in mentioning Maurice Oldfield, says “MI5 decided to expose his latent homosexuality anonymously to the media”.

On the contrary, Sinn Fein is the political branch of the Provisional IRA, in total opposition to Continuity IRA, which is a dissident, break-away group.
