Conviction record is defined as information indicating that a person has been convicted of any felony, misdemeanor or other offense, has been judged delinquent, has been less than honorably discharged, or has been placed on probation, fined, imprisoned or paroled by any law enforcement or military authority.
An employer may only refuse to hire a qualified applicant because of a conviction record for an offense that is substantially related to the circumstances of a particular job.
A conviction record that is not substantially related to the particular job should be given no consideration in the hiring process.

 Rules of Post-Conviction Remedies
A proceeding under this Rule is commenced by filing three (3) copies of a verified petition with the clerk of the court in which the conviction took place.
If the court finds in favor of the petitioner, it shall enter an appropriate order with respect to the conviction or sentence in the former proceedings, and any supplementary orders as to arraignment, retrial, custody, bail, discharge, correction of sentence, or other matters that may be necessary and proper.
