  CoolBrands Sues Weight Watchers/Well's Dairy for $360 Million
CoolBrands International, Inc. has filed a lawsuit against Weight Watchers International, Inc. and Well's Dairy, seeking $360 million in damages over an alleged breach of a licensing agreement.
Coolbrands, the maker of Eskimo Pies, said the deal includes the right to continue to use the trademark to sell out inventory through Sept. 28, 2005.
The CoolBrands lawsuit alleges that Weight Watchers unlawfully entered into a licensing agreement with Well's Dairy in July, violating an agreement that it would not enter into future licensing agreements for its Weight Watchers trademark on frozen novelties and ice cream until the CoolBrands deal expired this September.

Coolbrands International Inc., the maker of Eskimo Pie ice cream bars and other frozen desserts, reported a flat fourth-quarter profit on Tuesday as the stronger Canadian dollar melted the company's earnings.
Coolbrands, which is in the middle of a legal dispute with Weight Watchers International Inc. over licensing rights to a dessert line, said it earned C$14.7 million, or 26 Canadian cents a share, for the period ended Aug. 31.
For the fiscal year, Coolbrands earned C$48.8 million, or 87 Canadian cents a share, up from C$31.7 million, or 59 Canadian cents a share, in the previous year, which was in line with earlier company estimates.
