The east section of Comanche County was opened for settlement on August 6, 1901 by drawing the names of those who had registered at U.S. Government offices at either El Reno or Fort Sill.
The western part of the county (commonly known as the Big Pasture) was sold by sealed bids on December 17, 1906.

The existing Oklahoma statutory rules against restraints on alienation of property, the constitutional provision referring to perpetuities and the statutory provision providing a limitation of time for the existence of express trusts, are designed to prevent the accumulation and retention of property in the hands of private individuals.
An Oklahoma county has the power to accept a devise or bequest of property as a charitable trust and administer the same as trustee, provided the purpose of the trust is consistent with the purpose of the creation or existence of the county.
A charitable trust which is for the benefit of the aged and poor of a named county in their declining years is sufficiently definite as to beneficiaries to meet the legal requirements concerning certainty of beneficiaries of such a trust.

Gibson's petition-in-error recites a factual background purportedly explaining that he was transferred from State incarceration to custody in the Cotton County jail.
