Nevada Supreme Court cases 1 through 2507 are available on microfilm for the years 1863-1921 at the State Library and the Special Collections Department at the University of Nevada, Las Vegas Library.
Original case files that are also available on microfilm may be researched in the Archives but not photocopied unless the microfilm is damaged or unreadable.

 Historic Supreme Court Cases
The Court ruled that to force the Amish to comply with the compulsory attendance law means that they must either leave the state or risk the loss of their children to a secular society.
The Court reasoned that, "A way of life that is odd or even erratic but interferes with no rights or interests of others is not to be condemned because it is different." The Amish offer their children an "ideal" vocational education, instilling in them the social and political responsibilities of citizenship.
This case passed the first test, i.e., the purpose of the statute was secular and not religious; its legislative intent was to improve the quality of education.

 Supreme Court Cases for AP Review
The decision stems from the Yazoo land cases, 1803, and upholds the sanctity of contracts.
Sometimes called "the sick chicken case." Unanimously declared the National Industrial Recovery Act (NIRA) unconstitutional on three grounds: that the act delegated legislative power to the executive; that there was a lack of constitutional authority for such legislation; and that it sought to regulate businesses that were wholly intrastate in character.
The court ruled that those subjected to in-custody interrogation be advised of their constitutional right to an attorney and their right to remain silent.

As of September 19, 2005, the courts have begun to release decisions of the Superior Court Appellate Division which have not been approved for publication as well as approved decisions.
Be aware, however, that court rules for the use and citation of "unpublished" decisions are different than those for those designated as "published".

On appeal from the Southern District of Ohio (71 F.Supp 2d 824) and the Sixth Circuit Court of Appeals (unpublished), this case was denied cert.
The effect of this last minute appeal to the Supreme Court (Justice Stevens is the Circuit Justice) was to lift the Court of Appeals stay on the District Court’s injunction of the city’s ordinance restricting the use of the square for a seven-week period.
This week (12/16/02) the full Supreme Court reaffirmed Justice Steven's opinion and rejected the city's arguments that it should be allowed to stop all private groups from using the square during the holidays.
