WWCC has a claim of ownership and equity in any intellectual property when an individual produces it as part of an assigned duty or with the substantial use of College resources, facilities, or funds except as provided in a written agreement.
To protect the rights of the individual and the College, the ownership and equity of intellectual property developed after the approval of this procedure may be determined before an intellectual property is developed.
Similarly, any equity or profit derived from the intellectual property may belong solely to the creator or shared with the College depending on the conditions in which the property was developed.

On May 17, 1991, a member of a white supremacist organization called the Church of the Creator murdered Navy Shipman Harold Mansfield, an African American sailor who served in the Gulf War.
The "Church's" mission is to preach "Creativity," which asks its followers to "purify" the white race, eliminating "mud races" and Jews from the earth.

In 1987, the U.S. Patent and Trademark Office granted the foundation's request to copyright the name "Church of the Creator." After five years during which no contest was filed against its trademark, the foundation's ownership of it became legally "incontestable," even though Creators had used the phrase since COTC's founding in 1973.
Hale took over what was then called the Church of the Creator in 1995, two years after its founder Ben Klassen, depressed over the death of his wife, committed suicide after several attempts to install a successor.
On Jan. 8, the so-called "Pontifex Maximus" of the WCOTC was arrested in the federal courthouse in Chicago and charged with obstruction of justice and solicitation to murder a federal judge.

However, there is an exception to the "creator is the owner" theory and this is when you are dealing with works "made for hire." If an item is considered a work "made for hire," then the requestor/employer, not the creator, is considered the owner/author.
The majority of the time, the creator of the work is considered the owner with regards to copyright protection and reproduction.

I'd say the damage had been done when the original creator (definition: the guy who MADE the freakin' thing!) was left out of the loop when plans were made to turn his work into a big screen film.
It looks like Dan DeCarlo didn't have much concern about trying to claim the rights to Josie before the movie, which could be understandable.

 Marvel's Work Made For Hire contract for Epic Comics
Exhibit A spells this concept out more explicitly, but the gist of WMFH is that the legal "creator" of the work is the company, and you're just one of the cogs in the creative machinery of that company, with no ownership of the work you do for them.
If you can't agree to the WMFH contract, you might consider instead pitching the story (without Marvel characters or MU elements) to Epic as a creator-owned proposal.
Because you (the writer who proposed it) are the one Marvel is paying, you're responsible for getting the artists working for you to agree that this is "work made for hire" like in paragraph 2.b, and you all agree not to challenge that.

I'm a few days late by now, but you need to read Newsarama's interview with Warren Ellis, in which he discusses, among other things, his upcoming creator-owned limited series (DOWN and RED), creator ownership, format, decompressed storytelling, and heroes in Ellis' stories.
And, in October:Minotaur Press gets DOWN with a new series by two of the most respected creators in comics.
And while Michael Avon Oeming, Frank Quitely/Trevor Scott, Eduardo Risso, P. Craig Russell, and J.H. Williams III are certainly very worthy nominees in the Best Penciller/Inker or Penciller/Inker Team category, it's absolutely criminal that John Cassaday and Bryan Hitch/Paul Neary were shut out of that category.
