The Youth Criminal Justice Act is a piece of Canadian legislation passed in 2002 that determines the way in which youths are prosecuted under Canada's criminal justice system.
The YCJA replaced the controversial Young Offenders Act which had previously regulated youth crime in Canada.
The new act borrowed many of its predecessor's principles, as well as Canada's repealed 1908 Juvenile Delinquents Act.

The law that was to replace the YOA was an attempt to impose a criminal justice model that was viewed as a step backwards that would threaten the educative and rehabilitation approach that had inspired the youth justice system built over the years in Quebec.
However, had this provision in the YCJA been inspired by a real concern for rehabilitation, the act would not have replicated the automatism of adult criminal justice; it would not have provided for the automatic release of youths in the community after two-thirds of their sentence, irrespective of whether they are ready or not.
The YCJA was seen as tending to transform youth justice according to a criminal justice model where the offence had a more central place and where the attempt to aim at such goals as education and rehabilitation would find more obstacles on their way, which conflicted with what Quebec had built over the years.

The Act enables a police officer to direct two or more people whom he or she 'reasonably believes' to be trespassing on land with the purpose of 'residing there for any period' to leave the land and to remove any vehicles or property which they have with them.
The Act also enables local authorities to direct people camping in caravans or other vehicles on unoccupied land, or on occupied land without the owner's consent, to leave the land and remove their vehicles from it: those concerned need not be trespassers nor have behaved in any particular way.
The 1994 Act exempts residential occupiers, or people acting on their behalf, from legal provisions penalising the use of violence to secure immediate entry into premises when someone on the premises is opposed to their entry.

The Young Offenders Act in 1984 was an attempt to establish a tighter legal framework by allowing charges on specific offences, and by placing responsibility for the offence on the offender.
It was criticized on many counts: for being too soft on the offender; for lacking a clear philosophy on youth justice in Canada; for inconsistent and unfair sentences; for not properly addressing serious and violent offences; for an overuse of the court system; and for not giving enough recognition to the victims.

The most significant addition to the VRA was a clause covering potential harm "caused to potential viewers or, by their behaviour, to society" by material dealing with "criminal behaviour, illegal drugs, violent behaviour or incidents, horrific behaviour or incidents or human sexual activity".
This notion of harm was introduced into the Act as a result of the 1994 Newson Report, which alleged that violent videos were capable of causing psychological damage, especially to impressionable children.
