CROFTER - LoveToKnow Article on CROFTER
By the Crofters Holdings (Scotland)Act 1886, a crofter is defined as the tenant of a holding who resides on his holding, the annual rent of which does not exceed 30 in money, and which is situated in a croftig parish.
The wholesale clearances of tenants from their crofts during the I9th century, in violation of, as the tenants claimed, an implied security of tenure, has led in the past to much agitation on the part of the crofters to secure consideration of their grievances.
They have been the subject of royal commissions and of considerable legislation, but the effect of the Crofters Act of 1886, with subsequent amending acts, has been to improve their condition markedly, ~nd much of the agitation has now died out.

It provides that, having obtained the necessary approval from the Crofters Commission and consent from the landlord, a common grazings committee "may plant trees on, and use as woodlands any part of the common grazings in accordance with the approval and consent".
The aim is to provide that where a crofter forestry scheme has been created the crofter (or crofters where the scheme is on a common grazing) has the exclusive right to cut, abstract, use and sell the timber and other forestry products derived from the woodlands created through the scheme.
Crofter woodlands created by regeneration rather than by planting will be treated in the same way as woodlands created wholly by crofter planting.

Like several of his other books, McPhee's The Crofter and the Laird is about people whose lives are still very much entwined with nature.
Crofter and the Laird is no starry-eyed and naive "back to the land" tract: McPhee describes the rigors and difficulties of this life with the same attention to detail he gives to the simple beauty of the land and lifestyle.

Irritancy is the right of a landlord to terminate a lease (in this case a croft tenancy) early as a result of the breach by the crofter of the terms of the tenancy and the crofter having failed to remedy that breach.
The effect of these changes is to afford a spouse or civil partner or cohabitant of a deceased crofter the same degree of protection in retaining the croft tenancy as the 1964 Act allows the spouse or civil partner of any other individual in retaining a dwelling-house owned by that person.
