The Environment and Heritage Service holds copyright on much of the material in the Monuments and Buildings Record, under delegation from Her Majesty's Stationery Office, and specific written authority must be sought to reproduce, publish or exhibit it.

But governments that may be unable to claim copyright within their territory may be able to claim it outside: copyright is a territorial right and it is irrelevant that a work is unprotectable in its country of origin if it otherwise qualifies for protection in the country where protection is sought.

Clearing copyright, whether it be for Crown or for other published or unpublished material also adds to the cost of businesses, educational establishments libraries and archives.
We wish to suggest, therefore, that the prime element in protecting Crown copyright is the need to protect the rights of paternity and integrity rather than the enforcement of the economic rights.
Removal of Crown Copyright may not necessarily make a difference to a possible increase in the information market as much material published by Government is of minority interest.

As the UK government abuses copyright law to stifle free speech and obstruct freedom of information, the case of Craig Murray reveals how the impulse of power to control dissent is crushing democratic rights anew.
Although Crown copyright does protect commercial enterprise in some instances (for example in the licensing of Ordnance Survey data, though the public value of this practice is also highly questionable), in this instance the threat of copyright infringement proceedings has been levied solely to prevent evidence of a government's misdeeds from entering the public sphere.
The US Digital Millennium Copyright Act and the European Union Copyright Directive (EUCD) hold internet service providers liable for copyright infringement if they fail to take down material hosted by their customers once they have been notified by a rightsholder that copyright infringement is taking place.
