Cryptic Studios was formed in July of 2000 when a group of three former Atari employees and two members of the paper and pencil role-playing industry came together under one roof.
Eventually, Cryptic decided that they had gotten far enough with the game on their own, and created the City of Heroes web site to declare their intentions publicly and generate game industry buzz that would attract the right kind of publisher.
Having a publisher has given Cryptic much more financial stability, allowing them to do things like move into a larger office in San Jose, CA, and grow their team to it's current 18 members (5 Programmers, 9 artists, 2 Game Designers, 1 contract Composer, and a CEO).

Marvel sued NCsoft and Cryptic Studios in November of last year, claiming that the City of Heroes online computer game allows players to imitate comic book characters owned by Marvel.
The judge also dismissed more than half of Marvel’s claims against NCsoft and Cryptic Studios, including Marvel’s claims that the defendants directly infringed Marvel’s registered trademarks and are liable for purported infringement of Marvel’s trademarks by City of Heroes’ users.
Although the judge allowed certain claims to survive the motion to dismiss, NCsoft and Cryptic Studios are pleased with the result and are confident that both the law and the facts will support their case.

 Posted - 11/13/2004 10:54:25 AM It is ridiculous for Marvel to sue NCSoft and Cryptic Studios, but, on the other hand, you have to wonder if anyone over at those game companies ever thought about the fact that it might be dangerous to have wolverine and hulk models in their game.
In my opinion, the case will blow over and Marvel will waste their time, however, in the case that Cryptic Studios wants to be cautious all they have to really do is issue a warning/semi-strict rule not to make characters look like Marvel characters.
Also for those commies/socialist/fascist who really believe that marvel has no legal grounds to litigate NCSoft and Cryptic Studios because the end user is the one who is infringing on the IP and not NCSoft/Cryptic Studios, think again.

City of Heroes developer Cryptic Studios has responded to reports that Marvel is suing it and CoH publisher NCsoft by describing the comic giant's allegations of copyright infringement as "meritless".
"As reported by The Associated Press, Marvel Enterprises Inc. and Marvel Characters, Inc. have sued NCsoft Corporation and Cryptic Studios," the developer confirmed on its website.
On Friday Marvel announced that it planned to sue Cryptic and NCsoft after learning that characters in the duo's City of Heroes MMORPG could be customised by players to look similar to Marvel properties - naming the Hulk and Wolverine specifically in its litigation.
