The final primary source of international law is the “general principles of law recognized by civilized nations.” Nowadays, the phrase “recognized by civilized nations” has virtually become obsolete, in recognition of the valuable contributions to international law by countries that may not, at some earlier time in history, have been considered “civilized” nations.

Regarding state actions that constitute custom, it held that “Either the States taking such action or other States in a position to react to it, must have behaved so that their conduct is ‘evidence of a belief that this practice is rendered obligatory by the existence of a rule of law requiring it.”22
Instant custom cannot be said to have formed in the case of antipersonnel landmines, since there was longstanding practice contrary to the new norm and since states did not reach consensus all at once.

This process must be distinguished from laws which exist from time immemorial, what I would call 'custom.' I am thinking in particular of the common law, which in the American system creates law through adjudication of disputes in the form of precedents.
For example, on the issue of same-sex marriage, the courts first confronting it ignored the fact that the statutes did not explicitly require marriage partners to be of different sexes and argued that public policy required it because the overriding purpose of marriage was to foster and protect procreation, an argument difficult to refute.
The dialogue is about custom, not law, and much like the writers of Leviticus 18-20 often invokes legend as a justification (for both sides).
