The COE Cybercrime treaty is an effort to take the experiences of the various legislatures that have attempted to define the problem of cybercrime and harmonize international laws so that a hacker who attacks a computer system from Wales may not escape prosecution because the conduct is not an offense in Warsaw.
The EU cybercrime treaty generally adopts the approaches taken by the United States in the Computer Fraud and Abuse Act of 1986, Title 18 United States Code Section 1030, and the U.K. Computer Misuse Act and the laws.
To that end, the COE Cybercrime treaty reflects existing law, particularly in the United States, concerning the nature of computer crime and the ability of law enforcement to combat it.
