  Jones Act maritime injury law
Seaman, injured while employed on vessel, has two remedies: one at law under 46 USCS Appx § 688 to recover damages with respect to his personal injury, and another under general maritime law for maintenance, wages and cure, latter being contractual which seaman has as matter of right, irrespective of negligence or fault.
Seaman may maintain action based both upon unseaworthiness of vessel and negligence and was not required to elect between the two; thus, jury could base verdict on both theories, and moneys awarded included damages under both theories.
Seaman was not entitled to dismiss suit for negligence under 46 USCS Appx § 688 in which he had not paid costs where he elected to proceed with prior suit in admiralty for negligence.

Appointed Lieutenant Commander on 15 April 1944, Seaman was declared missing in action on 1 May 1944 after inflicting substantial damage on enemy land and sea forces in the New Guinea area despite damage to his own aircraft.
For that action and for his judgment and skill in crash landing his plane in such a manner as to save several members of his crew, he was awarded the Navy Cross.

Keels for Castle (DD 720) and Woodrow R. Thompson (DD 721) were laid down 11 July and 1 August 1945 at Federal Shipbuilding and Drydock Co., Port Newark, New Jersey, Thompson was launched 16 March 1946; Castle was never officially launched.
Keels for Lansdale (DD 766) and Seymour D. Owens (DD 767) were laid down at Bethlehem Steel, San Francisco, April 2 and 3 1944.
Forty-five commissioned before the end of the war, 62 by the end of 1945 and 91 through 1946, followed by two more (Lloyd Thomas and Keppler) in 1947, four more (Epperson, Basilone, Carpenter and Robert A. Owens, with anti-submarine warfare modifications) in 1949, and a final one, (Timmerman, with an experimental engineering plant) in 1952.

McGovern, DD., present bishop of Cheyenne, was born in Omaha, in what was formerly the cathedral parish of St. Philomena, Oct. 14, 1872.
His education began with the Sisters of Mercy, but his college course was received at Creighton University in his native city, where he finished with the first class graduating from that institution, in 1891.

With the DD 692 SUMNER class continuing to be overloaded with anti-aircraft capabilities to protect the carrier forces, the resulting effect was a lack of speed and required range.
