Jamaica Gleaner - Probe of DPP's office healthy, lawyers say - Sunday | December 1, 2002
The Office of the DPP was established under the Jamaica (Constitution) Order in Council 1962, and it is the first time that an investigation is being initiated to probe the management of that department which now has a staff of 53 including 32 prosecutors.
Contacted last week for comments on the unfolding events at the DPP's office, he said the DPP's excessive power and his failure to report to Parliament had been discussed earlier last week, before the FIPA wrote Mr.
But, while recognising that the DPP ought not to be fettered in the execution of his duty, Senator Golding said that the DPP, by virtue of the power vested in him, should not be allowed to execute his functions without being accountable.

The DPP does so without consulting nor explaining to Court, except where the case was commenced by another authority like the IGG, or by an individual, in which case Court has to give consent to the discontinuation.

DPP’s new service means that GP practices and PCTs can pick and choose the information they need to fulfil local health information needs from a comprehensive range of resources.

Fears that the DPP would one day take control of the legislature led then-President Lee Teng-hui to push through a series of amendments to strengthen presidential power (for example, the premier of the Republic of China would no longer have to be confirmed by the Legislative Yuan).
The DPP rejects the one China principle as the basis for talks with the People's Republic of China and advocates a Taiwanese identity which is separate from the identity of Mainland China.
The first years of the DPP as the ruling party gave rise to questions on whether the DPP as a self-styled Taiwanese nationalist party was adequately sensitive to the ethnographic character of Taiwanese society, which in addition to arrivals from different eras and different regions of mainland China, also includes aboriginal minorities.

Particular focus is also given to the issues of the independence of the DPP and to whether or not the DPP has captured the confidence of the general public, as these were the two principal reasons for the establishment of the office in 1972.
While the DPP is now responsible for the decision whether or not to prosecute a member of the security forces in relation to serious crime, there is grave concern that the actual investigation into such crime is typically carried out by the RUC as the DPP has no direct investigatory powers.
The failure of the DPP to institute criminal proceedings against RUC officers in these cases represents a failure to protect the human dignity of the victims of ill-treatment, and a failure to bring the perpetrators of these actions to justice.
