  DVD Copy Control Assn., Inc. v. Bunner
DVD CCA filed the instant complaint for injunctive relief on December 27, 1999, alleging that Bunner and the other defendants had misappropriated trade secrets by posting DeCSS or links to DeCSS on their Web sites, knowing that DeCSS had been created by improper means.
According to DVD CCA, so long as Bunner knew or should have known that the information he was republishing was obtained by improper means, he cannot rely upon the general availability of the information to the rest of the world to avoid application of the injunction to him.
In support of this position, DVD CCA contends that the denial of an injunction would offend the public policies underlying trade secret law, which are to enforce a standard of commercial ethics, to encourage research and invention, and to protect the owner's moral entitlement to the fruits of his or her labors.

Now, it appears that the DVD Copy Control Association, the group in charge of CSS and other forms of copy protection, has decided to loosen the reins (PDF) ever so slightly.
Currently, there are some services that offer this feature, such as the CinemaNow Store, but their system only works with a fraction of titles in their movie library, and the attempt at adding their own copy protection resulted in burned movies that had serious defects and could not be played in all DVD players.
Probably not, as the DVD market saturated itself some time ago and most people simply don't purchase as many titles as they did when the format was still gaining in popularity.

It was the second time the Court of Appeal had ruled in favor of Andrew Bunner in his dispute with the DVD Copy Control Association, the exclusive licensing entity for the content scrambling system that protects the content of commercial DVDs from unauthorized use.
The DVD CCA dismissed the underlying suit after the case was sent back to the Court of Appeal and sought to dismiss the appeal as moot, but Justice Eugene Premo explained in Friday’s opinion that the court decided to resolve the issues because they were likely to recur.
Under those circumstances, Premo concluded, it was an abuse of discretion for the judge to conclude that the harm to the DVD CCA as a result of Bunner’s posting outweighed the harm that Bunner would suffer as a result of the injunction.

The DVD Copy Control Association -- a consortium of the major movie studios and consumer electronics manufacturers that licenses the encryption technology -- initially sued Bunner and others under California's Uniform Trade Secrets Act in December 1999, about three months after Bunner posted the code on one of his Web sites.
The DVD association first informed Bunner that he was breaking the law and asked him to remove the code from the Web site.
The DVD association had argued that the appeals court decision was equivalent to giving thieves the tools to replicate and distribute protected materials, such as movies, on a massive scale.

CSS is not even copy protection at all; it does not prevent anyone from making a bit-for-bit copy of a DVD, therefore all it prevents is the playing of a DVD by an unlicensed player.
The DVD Consortium has set themselves up as a monopoly, and they are using a tying arrangement to make even more money by requiring a very high licensing fee for companies to produce a player.
The DVD CCA also uses the analogy to the effect that breaking the encryption surrounding DVDs is like breaking into someone else's house: it is not their fault you broke in.
