 | | Amendment- “The right of people to be secure…against unreasonable search and seizure and shall not be violated…but upon probable cause.” Under the fourth Amendment, if a driver would not have been stopped due to the traffic violation (ie seatbelt) and defense could prove pretext, then charges would be thrown out. |
