The Ministry of Agriculture, Fisheries and Food is therefore conducting a review of the tribunal with a view to abolishing it on 31 March 2001.
This tribunal was set up to hear appeals from individual fishermen against their "days at sea" allocations.
Tribunal determines deadlines for implementation of its decisions as appropriate.

Temporary leasing could be retained to lease the unused portion of active producers' quotas, for hardship cases (on a case by case basis), and for the lease of entire quotas for less then 3 years.
The quota could be allocated at a capped price to defined priority categories, with priority to producers having made regular use of the temporary leasing scheme, and special provisions for new and recent entrants.
The scheme could also be run nationally to allow producers to all co-ops have an equal chance to acquire milk quota, although this may need to be completed with some form of regional ring-fencing, to avoid milk quota being drained from some areas.

Each producer has a butterfat representative level, which is based on the fat content of his/her milk deliveries during either 1984/85 or 1985/86 milk quota years, whichever is the higher.
When milk quotas were first introduced in 1984 individual quotas were based on deliveries during the 1983 calendar year plus 497 gallons for producers with deliveries of less than 14,000 gallons and 3.55% for producers with deliveries over 14,000 gallons.
The provision in the milk quota regulations under which quota is ring fenced in disadvantaged areas contributes to the retention of milk production in those regions of the country which are most vulnerable in terms of economic and social decline, and is of particular benefit to small scale committed producers.

Producer representatives on the CMSMC were accountable through a system of producer democracy that began at the district level, with elected district or regional milk committees.
Specifically, the producer was free to produce any amount of milk over his or her domestic marketing quota, i.e., over-quota production with the understanding that their return for over-quota milk would be based on actual world market-based prices, i.e., the prices realised from Special Class 5(e) sales, taking into account their individual cost structures.
New Zealand noted that Canada had noted that only those producers who produce in excess of 105 per cent of their quota were considered to be deliberately producing for the export market.

 Joint Committee on Statutory Instruments - Twenty-Fifth Report
Section 8(1) of the Tribunals and Inquiries Act 1992 (1992 c.53) ("the 1992 Act") provides that "the power of a Minister¼to make, approve, confirm or concur in procedural rules for any tribunal specified in Schedule 1 shall be exercisable only after consultation with the Council".
The Tribunals established by the 2002 Regulations are not specified in Schedule 1 to the 1992 Act.
Although in this case, the rules for the new Tribunals are essentially the same as the rules for the existing Tribunals which they replace, the Department on reflection intends to invite the Council to consider the procedures set out in the 2002 Regulations.

California dairy farms are guaranteed a uniform minimum return for their raw milk, regardless of the end use to which the raw milk is to be put by a processor (handler).
The quota price, which is the higher of the two, is paid for an amount of production that was originally determined for California dairy farms based on their respective shares in the 1960s of the market for raw milk used to produce fluid milk and that has been subject to certain adjustments in subsequent years.
And all such dairy farms are equally eligible to acquire "quota." By the same token, all raw milk produced at dairy farms outside California is treated identically, whether the dairy farm is owned by citizens of California or citizens of other States.

 The Dairy Produce Quotas Regulations 1994
Any document purporting to be signed by the Chairman or Deputy Chairman of, or the Secretary to, a Dairy Produce Quota Tribunal and purporting to state a determination (or guidance) of the Dairy Produce Quota Tribunal shall in any proceedings be evidence of such a determination (or such guidance).
Except as otherwise provided in these Regulations, the procedure of a Dairy Produce Quota Tribunal shall be such as the Chairman, or, in the absence of the Chairman, the Deputy Chairman, shall in his discretion determine.
The Dairy Produce Quota Tribunals for England and Wales, Scotland and Northern Ireland shall, if so required by the Minister, issue a joint written statement of general guidance in respect of the criteria to be used in reaching any determination and each Dairy Produce Quota Tribunal shall make its determinations in accordance with those criteria.

For milk produced within a producer's quota and subsequently exported, the price differential between the price for export and the higher domestic price is collectively borne by all Canadian milk producers.
These traditional sales - which are calculated into the national quota and thus constitute in-quota milk - are linked to certain trade opportunities, such as tariff-rate quotas of third countries that are traditionally made available to Canadian exporters, as well as sales arising out of longer term trading relationships.
All Canadian provinces are parties to the NMMP except for Newfoundland which is, according to Canada, not a party to the NMMP because its milk producers produce almost exclusively for the local fluid milk market and because Newfoundland has not traditionally contributed to the industrial milk supply that is the subject of the NMMP.
