Dan Gelber, D-Miami Beach, has suggested that Florida's Hurricane Catastrophe Trust fund should be "retooled" so that policyholders with unpaid claims can directly "tap" the money in the fund to pay for their hurricane damage.
Gelber said that, "most important to consumers, the fund's windstorm-insurance rates and all windstorm rates, would be lower, because it would not be profit-driven, nor pay taxes.
Gelber told the Democrat that Florida's insurance market has never stabilized, and despite the fact that insurance companies receive repeated approvals to charge consumers higher rates for less coverage, they are still fleeing the state.

State Rep. Dan Gelber (D-Miami Beach) — a former prosecutor for the U.S. Department of Justice — said that while the case doesn't involve section 252.36 of the Florida Statutes, it does explore the nature of a state of emergency declared by the governor.
While the case ended oddly, Gelber wrote that it still seems as though disobeying an evacuation order could fall under other Florida statutes that make it a misdemeanor to resist, obstruct or oppose an officer — or other empowered person — who is trying to carry out a law or legal duty.
Gelber reviewed state laws last week, and said that a governor-ordered mandatory evacuation probably gives the police authority to order someone out of his home in an emergency, and someone certainly can be arrested for resisting a lawful order by a police officer, Gelber said.

''It's almost like a duel clause," said state Representative Dan Gelber, a Miami Beach Democrat and former federal prosecutor whose wife is a state prosecutor.
Gelber believes that Florida's major prosecutor groups, populated by state attorneys who must run for reelection, stayed out of the fight, and many lawmakers supported the bill because they fear the NRA.
Law enforcement did not try to block the measure, siding with the NRA rather than opposing the group, as many sheriffs and police officials had done during the debate two decades earlier over right-to-carry.

In an early telephone call with Dan Gelber at the US Senate inquiry team he informed me that the US had found evidence that the AUM in 1992 had sent a research team to study at the Nicola Tesla museum in Belgrade, Yugoslavia.
Gelber being a Lawyer did not seem to understand much about this weapons system, but discussed it "in passing", as evidence for the AUM sect's deep desire to obtain exotic new weapons systems with potential for mass destruction - such as nuclear bombs and nerve gas technology etc.
I was greatly intrigued by Gelber's comments and pondered over their possible significance - if any - to the Banjawarn events of 28-05-93.

Her opponents counter that Florida's drop is not tied to the gun law and note that national violent-crime rates have been trending down.
More important, Gelber and others say, is that Florida still ranked second in the nation, behind only South Carolina, in violent crime in 2003, according to U.S. Census Bureau statistics.
Brady's best hope, as a national fight appears inevitable, is that there will be a backlash -- much like the bounce that gun control got in Florida in the 1980s when the loss on the right-to-carry law was followed by victories on waiting periods and background checks.
