Evans was sentenced to die for the murders of Scott Piechowicz and his sister-in-law, Susan Kennedy, in 1983.
One of the four appeals involved a claim that Evans' lawyer when he was sentenced to death for the second time rendered ineffective counsel because he did not conduct a proper investigation of Evan's childhood as required by a 2003 U.S. Supreme Court ruling.
She said Evans was raised in an abusive home plagued by violence, was sexually assaulted as a child and tried to commit suicide by swallowing a bottle of pills at age 11.

A.P. BURTON, funeral director and general furnisher, Erie, was born in Erie City Sept. 4, 1836, son of David and Elizabeth (Erwin) Burton, the former of Scotch extraction, the latter a native of Penn., of German descent.
David Burton came to Erie about 1810—11, and for many years was a wagon-maker, butcher, extensive dealer in cattle from 1863 to 1869, and was also a prominent coal dealer.

Joseph Ellicott had had much experience in such work, notably under his brother, Andrew, "in laying out the City of Washington, preparatory to its becoming the seat of government," his earlier experience, by the way, aiding him in the unusual platting of Buffalo.
Ellicott was selected by their general agent at Philadelphia as the most competent surveyor they could find.
Ellicott spent the greater part of that season, 1798, at Buffalo Creek, which name was now taken to mean the "Lake Erie" hamlet, rather than the Indian village.
