In an act of hubris on the part of the screenwriter, himself a former philosophy professor, David Gale is a philosophy professor at Austin University (shot on the University of Texas at Austin campus) crusading against the death penalty as one of the leaders along with his colleague Constance Harraway (Laura Linney) of Death Watch.
The result of the rape allegation is that Gale loses his job, and his wife leaves him with her son heading to Spain where the courts are not as favorable to the father and her father is the American ambassador.
Gale cannot deal with the loss of his son, and Constance is worn out form her work and her battle with leukemia.

 Dan Heller's Movie Review of "The Life of David Gale"
If that's not enough, everyone associated with Gale, including his lawyer and the entire "death watch" organization, seem to be curiously silent on his imminent execution - a behavior that's uncharacteristic of a group that deems the death penalty as should never, ever be implemented on anyone, regardless of their guilt or innocence.
Suspicions over the motivations of Gale and the others rise over the top when we aren't even presented with much more than a ghost of an "adversary" that would be out to frame Gale.
While it's probably the case that The Life of David Gale will appeal to mass audiences who will overlook the simplistic political statements, and be attracted to the "suspense/thriller" genre, I would prefer to put it to sleep quickly...

Audio problem: In the scene where Constance informs David that he has been put on official "sabbatical" and unofficially released (as a professor), she adds vocally that the vote was "4-2".
David starts talking "off the record" and when the camera angle changes, the book is now folded on the table.

Although the ending of "David Gale" was not totally a surprise - as the viewer could guess his way through, the last facts did render coherence and answered many questions (such as the passivity of Gale's attorney and the connection between the attorney and Dusty).
The contrast between moments such as this one (or Gale's frustration after his inability to talk to his son), the great sympathy the viewer has towards Gale and Constance and on the other hand the very fanatic radical actions were difficult to reconcile.

Unfortunately, it's entirely a matter of preaching to the converted; there isn't a single moment in which you think that David Gale (Kevin Spacey) might even possibly be guilty of the murder for which he has been condemned to death.
But he's also basically a skilled director; "The Life of David Gale" is handsomely photographed, well-acted and at least a little suspenseful (though the story would have worked better without that approach).
David Gale is another of the saintly roles that Spacey seems all too drawn toward, and he's no more believable her than he has been in other such parts.
