  David Gauthier - Wikipedia, the free encyclopedia
David Gauthier (born 1932) is a Canadian-American philosopher best known for his neo-Hobbesian social contract (contractarian) theory of morality, as laid out in his book Morals By Agreement.
Gauthier was born in Toronto in 1932 and educated at the University of Toronto (B.A. Hons., 1954), Harvard University (A.M., 1955), and the University of Oxford (B. Phil., 1957; D. Phil., 1961).
In addition to systematic work in moral theory, Gauthier's main philosophical interests are in the history of political philosophy, with special attention to Hobbes and Rousseau, and in the theory of practical rationality, where he begins from an attempt to understand economic rationality, rather than from Kantian or Aristotelian antecedents.

Gauthier has seen the claimant's level of depression change, frequently in response to stressors related to his medical treatment or the handling of his workers' compensation claim by the carrier.
Gauthier opined that the earlier records showed a stage in the claimant's life that was irrelevant, as the claimant had clearly established a consistent working pattern and level of coping for the twelve or thirteen years that he worked at the employer.
Gauthier's failure to diagnose the claimant correctly is troublesome in light of the length of the treatment, but not surprising in light of the apparent lack of success of the treatment.

Gauthier, however, believes that it is possible to explain social cooperation within the context of a view of human beings that is compatible with the assumptions of market economists and their philosophical offshoots.
Gauthier, however, is not a nihilist and he wishes not to deny the existence of a sort of morality but to demonstrate how certain moral constraints might actually be in the interest of this type of radical individual.
Gauthier, like free market economists, assumes that human beings are in some sense ideally rational, that they are free to identify their utilities as they please, and that they nearly have access to relevant information that will allow them to adopt appropriate strategies for realizing those utilities.

For Gauthier, moral outcomes are utility maximising in conditions of scarcity, competition and where cooperation is likely to yield a surplus, and, importantly, where there exists a general disposition to cooperate.
Gauthier attempts to accommodate this residue by attributing to his agents an ‘affective capacity' for morality, thereby discarding the ‘economic man' of the prisoners' dilemma and embracing the ‘liberal individual' (1986:330ff).
Gauthier recognises, and indeed argues, that economic man, who in machine-like fashion chooses strictly in accord with the demands of utility maximisation, fails the test of moral agency.

 Contractarianism
Hypothetical contract contractarians such as Gauthier counter that the point of the contract device is not to directly bind the contractors, but rather to provide a kind of thought experiment by which to discover the requirements of practical rationality.
According to Gauthier, moral constraint on the pursuit of individual self-interest is required because cooperative activities almost inevitably involve a prisoner's dilemma: a situation in which the best individual outcomes can be had by those who cheat on the agreement while the others keep their part of the bargain.
Gauthier argues that it is the outcome that minimizes the maximum relative concessions of each party to the bargain.

Gauthier's moral theory, “morals by agreement” (Gauthier 1986), is a theory about the nature and rationality of morality.
Gauthier's response to this is to argue that we misconceive practical rationality, even instrumental rationality, if we think the aim of rationality determines in any straightforward way the manner in which we should reason or deliberate.
Gauthier's discussion in Morals by Agreement is conducted in terms of “dispositions to choose” and specifically of “constrained maximization”, the disposition to cooperate with other cooperators even in circumstances where defecting is more advantageous.

David Gauthier is presented the 2004 Prairie Conservation Award by past award winner Greg Riemer.
David Gauthier, executive director of the Canadian Plains Research Center and geography professor, was presented with the Prairie Conservation Award at the 7th Prairie Conservation and Endangered Species Conservation Conference Awards Banquet in Calgary, Alta., Feb. 28, 2004.
In accepting the award, Gauthier stated that "...special recognition is particularly due to the University of Regina and the Faculty of Arts for providing the home base for my research over the past 19 years and for their enduring and enriching commitment to fostering a supportive environment for multi-disciplinary research.

Gauthier starts by drawing a connection between the suboptimal outcome of the famous Prisoner's Dilemma of game theory, and the suboptimal outcome of a market afflicted by externalities.
Gauthier himself doesn't seem to be any kind of fervent libertarian, though, and libertarians who eagerly delve into his work may find a few puzzling dissonances.
In discussing the market, Gauthier seems to be so impressed with how the system functions despite the intense competition between seller and seller (and between buyer and buyer) that he overlooks the cooperation that is both routine and necessary for the market's existence.

This dissertation provides a critical comparison of three liberal theories of recent issue, the theories of Joseph Raz, John Rawls and David Gauthier.
It explains how each theory takes a distinct approach in presenting the idea of a just liberal society; and how these different approaches stem from contrasting conceptions of practical reason and of the structure and content of a conception of the good as individual autonomy.
By contrast, Gauthier presents a market conception of liberal society that is grounded in the individualistic preference-based assumptions of rational choice theory; given these assumptions, the conceptual basis of a liberal political framework is presented as a rational compromise motivated only by mutually disinterested preferences-hence a want-regarding modus vivendi.

Focusing on the version of the argument developed in David Gauthier's Morals by Agreement, the article concludes that rather than leading to proportionate taxation, Gauthier's complicated formula for dividing social surplus (a variant of the Nash bargaining solution) at first cut leads to a tax scheme even more regressive than a head tax.
Gauthier appears to conclude otherwise because he gets the implications of declining marginal utility of income for Nash-type bargaining solutions exactly backwards.
In light of the difficulty of deriving proportionate taxation from Gauthier's premises, the article concludes that Gauthier's attraction to proportionality seems to be driven less by his premises than by the conclusion itself.
