The chances of the survival of Bosnia-Herzegovina are constrained by its Dayton architecture: the disequilibrium between its integrity, from the perspective of international law, and its partition, from the perspective of internal law.
The primary objective of the Dayton Accord was to halt the hostilities in former Yugoslavia and in Bosnia-Herzegovina.
The Dayton Accord was created with the decisive participation of the international community, and in particular of leading Western countries and of the European Union, and there is no doubt that they deserve credit for all the positive results of the Accord.

Dayton can and should be improved - not by reopening it, but by bolstering it with agreements like last year's New York Declaration.

 A Feminist Appraisal of the Dayton Peace Accords
A close examination of the Dayton Peace Accords leaves one with the impression that the responsibility for addressing past violations of human rights is being given to the international community, through both intergovernmental and nongovemment organisations.
The general references in the Accords to the necessity to work toward rehabilitation and reintegration have not proved sufficient to encourage either the national government or the Entities to address the situation of the victims, including the women who were raped and sexually assaulted.
It is not clear that the Accords or the negotiations leadiiag to the Accords gave sufficient attention to the importance of putting in place a mecimnism which would allow for an in depth discussion of the legacy of the war.

The Dayton Peace Accords, more formally known as the General Framework Agreement on Peace in Bosnia and Herzegovina, were signed in Paris on 14 December 1995 after negotiations in November 1995 at Wright-Patterson Air Force Base in Dayton, Ohio.
The Accords, which marked an end to the three-year conflict in Bosnia and Herzegovina, called on a number of international organizations, including the OSCE, NATO and the UN, to monitor, oversee, and implement the various components of the agreement.
The OSCE was mandated by Annex 1B of the Accords to help elaborate and implement three instruments: an agreement on confidence- and security-building measures (CSBMs) in Bosnia and Herzegovina (under Article II); a sub-regional arms control agreement (Article IV); and a regional arms control agreement applicable "in and around the former Yugoslavia" (Article V).

Tonight I would like to talk about the general importance of America standing and working for peace, and of making sure that once people choose peace, their lives are improved and they are rewarded for doing the right.
Without their efforts, there would have been no agreement in Dayton, no signing in Paris, and so tonight with this prize I also remember those three good men who loved our country and loved peace and loved the Balkans, and their families who made such a terrible sacrifice so that they could bring peace there.
I think it's worth recalling that as hard as it was to reach the peace agreement here, there was still a lot of work ahead, especially for our military personnel who worked so diligently to create the conditions of peace.

One must assume that the politics of the peace talks and the complexities of intra-NATO relationships were not conducive to putting these commitments into writing.
One must also wonder where the US delegation was getting its advice on the congressional mood, given that Congress on three separate occasions had called for the lifting of the arms embargo and already had allocated over $250 million for the immediate provision of weapons to the Bosnian government.
These commitments, however, do not enable the United States to fulfil an important piece of its military exit strategy; moreover, they fail to provide any realistic expectation that the Bosnians will have the means of defending their fledgling democratic state when NATO withdraws in time for the 1996 US presidential election.
