Om het zich ontwikkelende Chinese recht te verstaan is het echter wel nodig inzicht te verwerven in de culturele, politieke, economische en sociale geschiedenis van het land.
Het amusante van de Chinese wetten is dat ze zo veranderlijk zijn, soms volgt de ene ‘voorlopige’ wet de andere op tot de heren-leiders-van-het-proletariaat/volk een idee hebben van wat ze eigenlijk willen, en dikwijls is de practijk anders dan de wet.
Vanouds hechten Chinezen meer aan de practische dan aan de theoretische kant van de zaak, zoals Lin Yutang met een voorbeeld uitdrukt: het feit dat in het voor-communistische China de natuurwetenschappen niet tot ontwikkeling kwamen, is omdat Chinese geleerden bij het zien van dieren of planten zich voornamelijk afvroegen of ze eetbaar waren.

Ce traité ne fait aucune mention du nouveau propriétaire de l'île, en partie pour éviter de prendre parti dans la guerre civile chinoise.

Joao de Barros, an explorer and writer, wrote that the Chinese merchants used a form of biometrics by stamping children’s palm prints and footprints on paper with ink.
One of the first known cases of humans using biometrics to identify one another was by early Chinese merchants.
Possibly the first known example of biometrics in practice was a form of finger printing being used in China in the 14th century, as reported by explorer Joao de Barros.
