The situtation depends on whether the ball is a fair or foul ball, not the position of the runner.
If the runner has one foot on the base and the rest of her body is in foul territory and a ball is hit directly on the line and hits her, the ball is fair and then depending upon the position of the fielder, a ruling will be made on live ball/dead ball.

Let's face it, the defending team would be better served grounding the ball, but if they can't because they are on a 50/50 run with an attacking player and he slaps the ball over the dead ball line in a desperate run, why would a penalty be justified?
Well, not really...if they are both chasing the ball (attacker and defender) and the defender just manages to scramble the ball out of the attacker's reach and it goes over the dead ball line, I think a penalty is way too harsh....I would go for an attacking 5 m scrum.
You'd have to have a really cocky fullback who stands over the ball and waits for the opposition to close in before intentionally slapping the ball over the dead ball line, just for fun, before a penalty try can be awarded.
