The imposition of duty on the several forms of property making up an estate is accompanied by their 'aggregation,' a process essential for the ascertainment of the rate of estate duty, since it varies with the aggregate amount, beginning at one per cent.
The sum of property 'passing on the death' is a vital element in the assessment of the duty.
Starting from 1790, the duties on succession were somewhat increased by the measures of 1798, 1816, 1832, and 1850, the latter establishing the same rate of duty for 'movable' as for 'immovable' property (the former, contrary to the English rule, having been previously favoured).

Unfortunately, from the landowner’s perspective, death duties increased in 1909 and again in 1919, along with income taxes and servant’s wages; and although the agricultural depression had eased by 1900, it intensified once again in the 1920s, reaching its height in the late 1930s (Girouard 308).

Accordingly, Attorney General Opinion H-85 (1973) is limited to situations where a child is entitled to death benefits under article 6228f, V.T.C.S., and who is adopted prior to the death of the covered employee.
A minor child of a covered employee who is adopted prior to the death of the covered employee is not entitled to death benefits under article 6228f because the child's entitlement or right to the benefit does not vest until the death of the covered employee.
On the contrary, we believe that a child receiving benefits because a natural parent who was a covered employee has "suffer[ed] a violent death in the course of his duty," can continue to receive the benefits because a subsequent adoption does not have the effect of emancipating the minor child from disabilities of minority.
