Decree 43 894, of 6 September, 1961 - Regulation Regarding the Occupation and Grant of Land in the Overseas Provinces - This law was effectively revoked by the 1975 Constitution and the 1979 Land Law.
Decree 12/90 of 4 July was promulgated for the purpose of mandating the registration of the property nationalized under Decree 5/76 in accordance with the Real Property Registration Code, ignoring the implicit acknowledgment of this obligation to register such property set forth in the aforementioned Decree 9/76.
Decree 21/89 sought to achieve this regularization through the setting of time limits and specific obligations, but was considered too cumbersome and not appropriate for all sectors, especially agriculture.

Under Decree 90, developers must have equity of at least 15% of total investment capital for the implementation of such projects which utilise less than 20 hectares of land and 20% for projects utilising more than 20 hectares of land respectively.
Decree 90 provides that ownership of house; houses and land shall be documented via the issuance of House or House and Residential Land Ownership Certificate issued by the Department of Construction where the houses and/or houses and the land are located.
It is clear under Decree 90 that foreign individuals, overseas Vietnamese and organisations may not own residential houses which have been gifted or inherited by other individual(s) or organisation(s) and in such circumstances they may be entitled to the value of such houses only.
