The department is under the direction of an executive officer known as the Director of Fair Employment and Housing, who is appointed by the Governor, subject to confirmation by the Senate, and who holds office at the pleasure of the Governor.

 How to file a complaint
Once a person files a complaint with DFEH, the Department has ten (10) days to notify the party complained about of the alleged discriminatory housing practice and to advise him or her of the procedural rights and obligations under the law.
The DFEH is only allowed to dismiss a complaint if a person withdraws the complaint or if "no reasonable cause exists to believe that an unlawful housing complaint has occurred." This significantly limits the DFEH's discretion in dismissing fair housing complaints.
A recent amendment to the Fair Employment and Housing Act requires that DFEH and the state attorney general comply with the Rules of Professional Conduct with respect to their representation of the complainant.
