Their Diebold GEMS central tabulator software, version 1.18.15 of which counted most votes in the United States in the U.S. presidential election, 2004, is at the center of extreme controversy for apparent irregularities versus the U.S. presidential election, 2004, exit polls.
Diebold attempted to stop the release and publication of a number of internal memos by sending cease and desist letters to sites hosting these documents demanding that they be removed in violation of the Online Copyright Infringement Liability Limitation Act provisions of the DMCA found in ยง 512 of the United States Copyright Act.
Consequently, Diebold itself was sued by the EFF and Stanford Cyberlaw on behalf of the Swarthmore Coalition for the Digital Commons, who claimed damages and cost.

Walden O'Dell, chief executive of North Canton-based Diebold Inc., confirmed in an interview with Plain Dealer editors that he has been a top fund-raiser for the Republican president, but said he intends to lower his political profile and "try to be more sensitive" in light of the national criticism he has faced.
Because the fund-raising revelations fell closely on the heels of security questions raised about Diebold's machines in a later-questioned Johns Hopkins University study, O'Dell's critics began to suggest that Diebold should not be allowed to be involved in elections.
He called Diebold "a model of integrity and reporting and clarity and disclosure and consistency" and said he hopes his company - which employs 3,000 Ohioans - does not suffer because of his personal mistake.

And just in case you were wondering whether Diebold employees are politically active (remember, employees for government entities are restricted in various ways on this including campaign contributions because it's a conflict of interest), the California database for 2004 election contributions shows this: 26 Contributions (to date) for political candidates and committees.
While the quality of Diebold software is at issue, the only reason they can get away with crappy software is that there's no easy way to tell when they fuck up.
The key here is that government employees cannot donate to campaigns because it would be a conflict of interest, and yet Diebold, as a provider of the same service that the Registrar's office used to provide all on their own, can make contributions.

Three University of Chicago students have joined the “electronic civil disobedience” campaign against the Diebold Corporation, hosting copies of internal documents hacked from Diebold’s computer database on their websites that reveal serious flaws in the polling company’s practices.
Diebold refused to speak to the Associated Press for an article written on October 29, although David Bear, a spokesman for Diebold, told The New York Times that “We reserve the right to protect that which we feel is proprietary,” in an article published Monday.
Critics of Diebold maintain that calling the documents “proprietary” implies that the documents are also legitimate.

“[Diebold] might be waiting for the outcome of the countersuit in California by the original two Swarthmore students, or they might have realized that [sending letters of cease-and-desist] wasn’t effective,” Chijiiwa said.

 Diebold Machines Yield Fishy CA Results
I ran a number crunch of CA counties that use Diebold machines to cast/count votes and found some weird figures that show a skim of votes from top candidates to people who were unlikely to affect the outcome.
I added all the votes cast/counted on Diebold equipment for each candidate and expressed it as a percentage of their total votes cast state wide.
In Diebold counties (those who use machines made by Diebold, a corporation that supports George Bush) the results are skewed towards low scoring candidates by unbelievably large amounts.

Yeah, I read when Diebold made its sales pitch to the government of Ohio the president of Diebold said he was committed to delivering all the Ohio Electoral Votes to George Bush in the next election - but perhaps he was just being a tad enthusiastic.
Yeah, out here in California our folks, led by Barbara Boxer, are insisting Diebold alter their machines to provide each voter a receipt, and provide a "paper trail" for the official records.
Diebold says that will triple the cost of the machines and cannot be done fast enough for the next election - lots of coding and hardware changes would be necessary.
