Legal Technology - Search Terms Mean Savings in E-Discovery
Ultimately, the court's discovery order minimized the amount of ESI review needed to find documents responsive to plaintiff's requests, and allowed for the efficient review of a large volume of potentially responsive information.
Whether by agreement or court order, if search terms are employed to make the discovery process less of a burden for all parties, a litigator should be aware of the positives and pitfalls of using search terms, and how their use can miss information as well as reveal it.
If agreed terms of discovery were later found to be expensive or burdensome, under the new Rule 26, the request can be denied, limited, or its cost-burden shifted in a "share or bear" scheme.
