Petitioners (the Karuk and Yurok Tribes, as well as a number of individual Indians) filed suit against the United States, contending that the Settlement Act deprived them of property and that they were therefore entitled to compensation under the Just Compensation Clause of the Fifth Amendment.
Members of the Karuk Tribe were dispersed in both areas but principally occupied aboriginal lands to the east of the reservation.
The Karuk Tribe alleged that the Settlement Act, by excluding the Tribe from the settlement, took property of the Tribe without just compensation, in violation of the Fifth Amendment.
