If the District Court of Australia had proper jurisdiction to rule on the validity of the Release, as it already had, it is hard to imagine how seeking enforcement of that ruling would be vexatious.
Whether or not the District Court for the Southern District of Texas has jurisdiction of this case is a function of whether or not the Australian court had jurisdiction of the suit filed by MacPhail to secure that court's approval of his original settlement agreement and release with Oceaneering.

 Allanson v. Toncich
It is that the respondent found herself defending the action in the District Court because that was where it was brought, the appellant contending that a proper award of damages would well and truly exceed the sum of $25,000, the limit of the Local Court jurisdiction.
Having succeeded to the degree she did in the District Court and having obtained an order for costs there, her contention is that the order should have been that she have the costs after 27 September 2001 taxed on the scale appropriate to an action in the District Court.
As the respondent was therefore not exposed to a greater award of costs against her than if the action had been tried in a Local Court, it would not seem to me to be a necessarily inappropriate exercise of discretion to award her costs to be taxed on the appropriate Local Court scale.

Where, by reference to the evidence, the Court concludes that all the goods in issue should be taken not to be conforming goods, then Article 50 has the effect, as I have found, that the price of the goods in question should be reduced to zero.

Western Australia was, and indeed from its geographical position must have been, the first part of the continent to become actually known, lying as it does just off what was then the main trade route to the East.
Although the existence of the western side of the continent had been known for certainly two, and possibly three, centuries, it was not until the third decade of the nineteenth century--some forty years after the foundation of the colony of New South Wales--that the British Government decided to take steps to found a settlement there.
