In New Zealand, there have been several controversies regarding list MPs who left their parties — Alamein Kopu, elected from the Alliance list, controversially defected and gave her support to the Alliance's enemies, and Donna Awatere Huata, elected from the ACT list, became an independent.
In the latter case, Awatere Huata's former party went to the Supreme Court to expel her from Parliament.
ACT alleged that it was ACT, not Awatere Huata, who was awarded the seat in the last election, and that when Awatere Huata left ACT, she should not have been able to take the seat with her.

In the Huata case, Mrs Huata challenged the decision of Richard Prebble as parliamentary leader of ACT, and Ken Shirley (as acting leader), to invoke the procedure laid down by the party-hopping amendments to remove her from Parliament.
Mrs Huata argued in support of the Court’s jurisdiction to intervene on the basis that the leaders and caucus were exercising, in judicial review terms, “statutory powers of decision”, and thus the decisions were not proceedings in Parliament in relation to which the Courts ought to decline jurisdiction.
Mrs Huata argues this is an action of the ACT leader and the Speaker, and therefore cannot be her “actions” in terms of the party-hopping amendments.

The judgement of the Supreme Court in the Donna Awatere Huata case has been issued - this is the first case the NZ Supreme Court has heard.
I can't disagree with the judgment (not paying your dues seems to be to be a fairly clear cut way of leaving an organisation to me), but I do think it's a good think the waka-jumping legislation is going to lapse.
Selecting someone like Awatere Huata as a list MP doesn't seem to show much judgment and I think political parties should have to live with their bum decisions.

The Court of Appeal ruled today that Mrs Awatere Huata's actions had not amounted to defection, and that ACT could not therefore invoke legislation to have her thrown out of Parliament.
“Whatever you think of Mrs Awatere Huata’s behaviour it should be fundamental to our democracy that unless an MP has been convicted of a significant offence, only the voters have the power to elect and un-elect them,” said Mr Donald.

I think Donna is entitled to continue with her job as an MP until serious accusations against her are proved correct.
It is premature of the ACT party to suspend her and i think they are using all sorts of other things i.e.
I agree with Donna "to put the boot in, is going too far".

In general I see Donna as an entrepreneur in the crudest sense of the word - the sort of entrepreneur who takes the ups but not the downs.

The Huata case began its life 12 months ago when Mrs Awatere-Huata sought an injunction in the High Court in Auckland preventing Richard Prebble and Ken Shirley (as then leader and deputy leader, respectively, of the ACT Party), from invoking the Electoral Integrity Amendments to remove her from Parliament.
First, Mrs Awatere Huata appealed against the High Court decision to the Court of Appeal, which decided 4-1 in her favour.

The good news for embattled MP Donna Awatere-Huata is that the Court of Appeal has denied ACT an urgent hearing to overturn the High Court injunction.
This means she will remain an MP until the substantive hearing in February or, if sucessful with that, until she gets convicted, as any of the crimes she has been charged with would automatically trigger the Electoral Act.
