It's been said that "Down by Law" is not about hip but about the way hip insulates you from life, and you can find that in the performances -- Benigni, a comedian famous in Italy, pumps life into "Down by Law," just as Lurie's dour self-involvement sucks life out of it.
There's a kind of snobbism just beneath the surface of "Down by Law," a movie that isn't about the liabilities of a certain kind of attitude toward life, but about having that attitude and not being able to pull it off.
In "Down by Law," he's made that kind of movie, but he's worked from the outside in.

"Down by Law" is shot in wonderful fl and white, which gives the film both a starkness and bare-bones feel.
I suspect that there was a good amount of improvisation throughout "Down by Law", but that didn't help some of its pacing problems.
Though the photography of the film was wonderful, it couldn't help divert from the fact that there were times when the film really dragged for me, like Jarmusch had left the camera on and the principals were just kind of doing their thing, though not in a compelling manner.

Down By Law is a comedy with a difference, directed to stand apart from the common herd.
In fact, Down By Law takes its avoidance of expected scenes a step further by neglecting to include moments that would be pivotal in any other film (such as courtroom sentencing, an explanation of why Zack and Jack were set up etc).
The extra clues that this is a Jim Jarmusch feature are that the off-key jokes and the fact that the passing of time is barely referred to even when the jumps between neighbouring scenes can be seconds or weeks (only scratch marks on the cell wall gives an indication).

We see Zack in prison first.  Alone in his cell, the enormity of his situation is evident on his face.  He passes the time staring and rocking on his bunk, occasionally shaking his head in disbelief.  After several days, Jack joins him in the cell.  Immediately, Zack changes his behavior.
The inspiration for Down By Law was one of Jarmusch's favorite Lee Marvin pictures, Hell In The Pacific.

Windwardtidesandwaywardsails is classic Down By Law, with melodic guitars, buried drums and pounding chord progressions, with snotty voices melted on top.
There's not really anything new here, save for the fact that this is probably their most melodic record to date.
