The Convention determining the State responsible for examining applications for asylum lodged in one of the Member States of the European Communities (hereinafter the Dublin Convention) was the first result of the Member States' inter-governmental efforts to harmonise, or at least, co-ordinate asylum policy.
ECRE is concerned that the Dublin Convention does not contain provisions regarding the social and economic rights of asylum seekers awaiting a decision on the Member State responsible for processing their asylum application or awaiting transfer to the responsible State.
ECRE reminds Member States that the principal objective of the Dublin Convention, expressed in paragraph 2 of the Preamble, is the "harmonisation of their asylum policies" and that this is a prerequisite of its functioning in a fair and non-discriminatory manner.

Although an applicant cannot derive from the Dublin Convention an individual right to a material examination of his or her claim, it is the explicit objective of the convention as set out in the Preamble to provide asylum seekers with safeguards that their claims are examined in one member state.
However, Article 3 paragraph 5 of the Dublin Convention retains the right of the contracting states to refer a claimant to a non-EU state instead of sending him or her to the state responsible.
The Convention of Dublin is perceived to serve the function of burden-sharing within the Community.

This proposal for a Council Regulation is the intended replacement to the Dublin Convention in laying down the criteria and mechanisms for determining the Member State responsible for examining an asylum application lodged in one of the Member States by a third country national.
ILPA's view has long been that the Dublin Convention was unworkable, in so far as it seeks to tie responsibility for examining an asylum application with responsibility for the applicant's entry into the European Union and that it should instead be based on where the asylum application is in fact lodged.

The Dublin Convention is essentially a mechanism for determining which Member State of the European Union is responsible for examining an application for asylum lodged in one of the contracting States.
