  E. F. Hutton - Wikipedia, the free encyclopedia
Edward Francis Hutton (September 7, 1875 [or 1877 or 1882] - July 11, 1962) was an American (born in New York, New York) financier and co-founder of E.
The Hutton companies also managed many mutual funds and other investment vehicles, some of which were separately incorporated and/or registered, and participated actively in corporate mergers and public offerings of securities.
Thus, Hutton was, in effect, getting short-term loans (termed "the float") from the banks for free and forcing the banks to make those loans by threatening not to keep its accounts with them if they did not.

 Blankenheim v. E. F. Hutton & Co. (1990) 217 CA3d 1463
Hutton and Company, Inc., and Frederickson moved for summary judgment and the court granted their motion, ruling that (1) plaintiffs' reliance on Frederickson's representations was unjustifiable as a matter of law, and (2) plaintiffs had waived their alleged claims.
Since E. Hutton's summary judgment motion was predicated, at least in part, on the contention that plaintiffs were "well-educated and sophisticated businessmen with extensive experience in business finance" who should have known better than to rely on Frederickson's representations, we begin with a summary of plaintiffs' prepurchase educational and business experience.
Hutton next argues that the private placement memoranda, subscription agreements and hold-harmless agreements were replete with warnings of the high risk involved which contradicted the representations upon which plaintiffs claim to rely.

On the statements for the months of April through July 1984, handwritten notations indicated that a portion of the margin interest charges was attributable to the amounts forwarded to the estate while a portion was attributable to funds which the trusts lent to Edith Kermer.
It does not illuminate whether the trusts, in transferring the borrowed sums to the estate, intended those transfers to be bona fide loans subject to an unconditional obligation to repay or whether the estate intended to be bound by an unconditional obligation to repay the advances.
E.F. Hutton lent funds to the trusts on terms radically different from the terms on which the trusts advanced the same funds to the estate.

 E. F. HUTTON & CO. v. CITY NATIONAL BANK (1983) 149 CA3d 60
Plaintiff Hutton, in the second cause of action, alleged that defendant CNB, as the collecting bank, warranted that the indorsements on the checks were genuine and that since they were forged, CNB was liable for breach of warranty of good title.
However, Hutton's entire second amended complaint, when read in conjunction with superseded pleadings and realistically, in a common sense manner, showed that section 3405 was applicable to the facts.
Having concluded that plaintiff Hutton has not pleaded viable causes of action based on negligence and breach of warranty theories, the cause of action based on a common count theory, concededly based on the same series of transactions as was defectively set out in the other specific counts, is equally subject to demurrer.

The problem, as our lead story points out, is that each title and each job description today comes with a different set of rules and a different set of obligations to consumers.
