The European Economic Area (EEA) - Overview
(EEA Agreement) was negotiated between the Community, the then Member States, and seven member countries of the EFTA and was signed in May 1992.
The EEA was maintained because of the wish of the three remaining countries - Norway, Iceland and Liechtenstein - to participate in the Internal Market, while not assuming the full responsibilities of EU membership.
Through the double impact of the participation in the decision shaping and the high level of integration of Community acquis into their national legislation, the EEA EFTA States are, of all the countries associated with the Union, technically the most closely linked to the EU.

While the number of prosecutions under the EEA to date has been small—especially in light of the estimated losses resulting from trade secret theft last year—the fact that these prosecutions were brought at all demonstrates that the EEA is real and marks an important development in the effort to safeguard corporate trade secrets.
The EEA further expressly provides that in any prosecution or other proceeding under this Act, the court is to take all steps as may be necessary to preserve the confidentiality of trade secrets, consistent with all other applicable laws.
Supporters of the EEA would say that such access should not be permitted, and even suggest that the issue of whether the information is proprietary economic information covered by the EEA not be litigated in the early stages of the prosecution but rather simply be assumed.

Criminal Consequences of Trade Secret Misappropriation
The indicted and unsealed cases approved by the Department of Justice involving prosecutions of EEA violations reflect that the heartland of EEA criminal conduct excludes historical disputes in which a putative defendant’s intent and knowledge are not easily illuminated by his statements and conduct.
