The Earldom of Kellie was united with the Earldom of Mar in 1835, when the ninth Earl of Mar became also the eleventh Earl of Kellie.
His son, the thirteenth Earl of Kellie, renewed the petition, and the Lords decided the matter in 1875, determining that the Earldom of Mar properly belonged to the Earl of Kellie.
The Earl is Hereditary Keeper of Stirling Castle.

The Earl died in 1866, leaving no issue, and was succeeded by his nephew, a son of his sister, John Francis Erskine Goodeve, thirtieth Earl of Mar. He succeeded as heir-general to his uncle, according to the law of Scotland, which had prevailed at least for five or six centuries.
The Earl of Mar at once presented a petition as Earl of Mar, asserted his right to the title, and protested against the claim of the Earl of Kellie.
His main point being that according to the judgment of the House of Lords, the Earl of Kellie had proved his claim to "Earldom of Mar, created by Queen Mary in 1565," therefore his precedence should be in accord with the date of the creation of the Earldom.

High up on the south wall are the initials of his wife, Margaret Hay, (daughter of the powerful Earl of Errol.) It is believed that this tower was built by the 4th Lord as a jointure-house (a property set aside for the wife after the husband's death) for Margaret.
Kellie is a tourist attraction today and is open to the public.

One of the finest castles in Scotland, Kellie Castle is a tall 16th-century E-plan tower house, consisting of a three-storey main block and three large square towers which form the E. The Vine Room, on one of the upper floors, has a ceiling painted by De Witt, and there are fine plaster ceilings elsewhere.
It was bought by Sir Thomas Erskine of Gogar, who was made Earl of Kellie in 1619, a favourite of James VI.
Kellie was abandoned in 1829, but in 1878 James Lorimer leased Kellie as an almost roofless ruin and proceeded to restore it.
