Mar, one of the ancient divisions or provinces of Scotland, comprised the larger portion of Aberdeen-shire, extending from north of the Don southward to the Mounth.
On the earl's death in 1435 the earldom was claimed by Robert, Lord Erskine, as heir of Gratney, earl of Mar, through a daughter; but the Crown claimed as reversionary under the xeation of 1426.
At his death in 1866, his earldom of Mar was the subject of rival claims, and the right to the succession was not determined till 1875.

On the 15th of May, 1457, Lord Erskine’s claim touching the Earldom of Mar came before a Justiciary Court, held in the Town Hall of Aberdeen, at which the King was present as prosecutor in his own cause, and Sir William Crichton, the Lord Chancellor, as his advocate.
In 1459 the gross money rental of the Earldom of Mar was £396 10s, with thirty head of cattle, for each of which was allowed, and two chalders and four bolls of "custom oats," for each of which 4d.
The Earldom again reverted to the Crown, and continued in its possession for a period of upward of 60 years, during which there were no Earls of Mar.

If Viscount Mountgarret proves his presumed claim to the 1328 Earldom of Ormonde, the Earls of Shrewsbury would lose this distinction, but they derive higher precedence from their English earldom in any event.

The claims of the Barons of Allardice to the earldom of Airth, as heirs of the Grahams, Earls of Menteith, Strathearn and Airth, are well known to all students of the British peerage.
Since the Earldom of Menteith was, in the original patent of nobility, reserved for the heirs-male of the original Graham grantee (i.e., a Graham of unbroken descent in the male line), the Allardice claim, as heirs in the female line of the Grahams, did not give them a viable claim to that earldom.
In 1633 Charles I (son of James VI/I) regranted the Earldom of Menteith to the Grahams, under terms that precluded Graham claims to be heirs of David, Earl of Strathearn, but in partial compensation created the Earldom of Airth for the Grahams.
