The Eastern Harbour Crossing Ordinance provides that the tolls may be varied by agreement between the Chief Executive in Council and the NHKTC, but in the absence of agreement, either party may make a submission to arbitration for a final decision.

 Cross-harbour tunnel traffic rebounds
On the second working day after the Eastern Harbour Crossing's toll hike, there were 4,900 more cross-harbour vehicles than a day earlier, the Transport Department says.
In general, traffic flow on both sides of the harbour remained smooth up to 3pm, with 7,800 fewer vehicles than normal using the three tunnels, a fall of 6%.
The eastern tunnel saw a 22% fall, with about 8,900 less vehicles compared to a normal working day.

Two taxi drivers are to submit a writ to the High Court today to request a judicial review of the recent toll increase at Eastern Harbour Tunnel.
He said the New Harbour Tunnel Company should not be allowed a 15 to 17 per cent internal rate of return when the economy had been performing poorly in recent years.
The plaintiffs of the case, Chan Yu-nam and Poon Tat-keung, are taxi drivers based in the eastern part of Hong Kong and Kowloon who often have to take the tunnel.

The newer Eastern and Western tunnels are owned and operated by the private companies that developed them, but will eventually pass to the government.
The central location of the original tunnel makes it the most popular, and although the government doubled the toll for private cars when it took control, the operators of the other two tunnels have increased their prices so that it will soon be the cheapest again, presumably further increasing congestion.
Buying back the Eastern and Western tunnels is one option being considered by the government in an attempt to solve the toll controversy and ease public irritation over sharply rising toll charges.

In allowing the appeal, High Court judge Mr Justice Nguyen pointed out that the tunnel company and the police had tolerated the demonstration before the five were arrested.
Two others in the case were also given a similar sentence but it was suspended for one year.
