Arkansas News Bureau - Arkansas asks U.S. Supreme Court to pre-empt Oklahoma water lawsuit
Arkansas and Oklahoma have an agreed to a federally backed body for resolving water quality disputes, the Arkansas River Basin Compact, Beebe argued in his petition.
The root "of Oklahoma's grievance is that Arkansas law does not, to Oklahoma's satisfaction, adequately prevent the pollution of shared bodies of water and lands between the two states," Beebe petition states.
Rather than negotiate in the Arkansas River compact, Oklahoma "has instead sought directly to regulate economic activity occurring within Arkansas as a means to prevent the alleged pollution, thereby extending Oklahoma law beyond its territorial jurisdiction," he said.

Arkansas Attorney General Mike Beebe this morning filed a lawsuit in the United States Supreme Court accusing Oklahoma of circumventing the Arkansas River Basin Compact in its poultry pollution litigation.
Nowhere in Beebe’s suit does he claim Arkansas is exempt from federal pollution laws, despite the fact that Oklahoma’s lawsuit against the poultry companies includes allegations of federal violations.
For Mike Beebe, on behalf of the State of Arkansas, to come to the aid of corporate polluters is a clear sign of the companies’ desperation to stop this case from going to trial, Edmondson said.
